  • Horizon League files lawsuit against Valparaiso & MVC

The Horizon League has filed a lawsuit against Valparaiso University alleging breach of contract and tortuous interference after Valpo's departure to join the Missouri Valley Conference this past May.

HORIZON LEAGUE, INC., AN INDIANA ) NONPROFIT CORPORATION, ) ) Plaintiff, ) ) v. ) ) THE LUTHERAN UNIVERSITY ) ASSOCIATION, INC., an Indiana ) Nonprofit Corporation d/b/a VALPARAISO ) UNIVERSITY; and THE MISSOURI ) VALLEY CONFERENCE, INC., ) a Missouri Nonprofit Corporation,

kind of a Geno Ford-like situation except Horizon League suing Valpo & MVC for "liquidated damages" & Tortious Interference
for violating Valpo's agreement with the Horizon League requiring one-year notice to leave the conference.

Heck, if this is the case then the MVC needs to go after Wichita State and sue them & the AAC.

BTW- despite the examples they give of schools that did have to pay the buyout for leaving without notice- remember - Bradley just won the lawsuit filed by Kent State for essentially the same charges - that they interfered with Geno by hiring him and left without getting approval..

some funny comments regarding this lawsuit...

"...Missouri-based law firm...serves as general counsel for the Missouri Valley Conference ....???The Missouri Valley Conference is party (to the lawsuit) because our invitation to Valparaiso was somehow different than the Horizon League??™s invitation to IUPUI,??? Margo said sarcastically. ???I guess they are better inviters than we are.???

But Summit League Commissioner Tom Douple said...
"The Horizon League modus operandi is purging schools from our league...They would not be in existence without raiding our membership. This lawsuit against the Missouri Valley Conference is mind-boggling at best."
"With one hand, the Horizon League is penning a lawsuit with tortious interference (against the Valley) and on the other hand they are composing an invitation to one of our schools. Their actions appear to be contradictory and hypocritical."

Per a report in the Chicago Tribune:
The Horizon lawsuit against Valparaiso (and countersuit) have been settled & dismissed but details of the settlement not made public
...other than "all claims dismissed and each defendant pays their own legal costs & fees".

The Missouri Valley was also "dismissed as a defendant".

I had not heard this, thanks for sharing. Great news! Do you have any info or links to the decision? I wonder how much money it cost Bradley (and KSU) to litigate this vindictive case in the courts?
