It's should be a signal to everyone playing sports anywhere. Look at all the instances that have come out in just the past few weeks.
What part of illegal don't you understand?

He's suspended for 3 games.....what did you want?.....they said they would deal with it and they did....just because some think they should have announced it sooner doesn't mean they are wrong.

I was talking about all the instances that came out all over, not just the Barnes case.

          • Back to the topic...

Auston Barnes' attorney has filed a motion requesting a change in the upcoming hearing -

as of right now they are still on the docket for
a Status Review on Oct. 29 at 10:00 AM before Judge John Vespa, but I expect that might change now...

As expected, at the court hearing today, the judge assigned to the Auston Barnes case has recused himself (as was requested by Barnes' attorney), and thus the case has been continued until November 21 until a new judge can be assigned.

as expected, then there'll likely be further delay - I don't expect much til after the season so any chance additional suspensions will be moot

                PJS now has a mention

but I had previously heard that Barnes' attorney was Tom Penn - but that column says he is being represented by Tim Penn.

                • as expected - the Nov. 21 hearing has also now been cancelled and will be rescheduled at a later date with a different judge...
probably wouldn't surprise me if this dragged out all the way 'til March..

                  • even though the article on Barnes yesterday stated that the next hearing was still set for November 21 - a new date has been assigned...
it has been rescheduled by Judge Kevin Lyons to Thursday, November 20 at 1:30pm
I am guessing that actually works out better for Auston, as the entire team would likely be flying to Corpus Christi on Friday the 21st.

                    • another pretrial hearing set for January

                      • Maybe the lawyers on the board can comment, but this sounds like there will be no out-of-court settlement, or no plea bargain or dismissal. It sounds like this case is proceeding to court. But thanks to their legal actions, delays, requesting a different judge, etc, they have now pushed the pretrial hearing back to January. That sounds like they will be successful in delaying any decision until after AB plays out the whole season, thus making the chance of any further suspension irrelevant.

                        • I still seriously doubt it will proceed to trial - cases that do proceed to trial sometimes end up taking years before they are resolved...
...for example - one of the guys who were involved in those Peoria home invasions a year and a half ago - was also in the same court yesterday - for another hearing and still has not gone to trial
