    Barnes is charged under this statute according to the court documents
    720 ILCS 5/12-3.2(a)(2)

    I am no lawyer but according to documents that explain these charges....

    He could be found innocent or negotiate a plea deal, but if found guilty here's an explanation of the possible penalties.

    If convicted the potential penalty is "up to one year in jail and a maximum fine of $2,500."

    (He could be sentenced to the time already served or any amount up to one year)

    In addition:
    ".. if found guilty and sentenced to jail, the defendant is not eligible for early release. While other offenders can receive day-for-day credit reducing their sentences, offenders who are convicted of an offense causing bodily harm receive no day-for-day credit under the County Jail Good Behavior Allowance Act, 730 ILCS 130/3.
    Domestic battery is one of the very few misdemeanors for which the court cannot give the defendant supervision. See 730 ILCS 5/5-6-1(c). Supervision is not a conviction and the record of supervision can be expunged. It is usually the preferred outcome in a criminal case.
    (a guilty verdict will stay on his record forever)

    But in a domestic battery case, the defendant has to be sentenced to a conviction. This is a mandatory minimum penalty. The conviction cannot be expunged or sealed. See 20 ILCS 2630/5.2(a)(3)(C)(iii).
    The conviction for domestic battery will also disqualify the defendant from ever possessing a firearm."



    Just recently the legislature amended this statute so that if the defendant has any prior conviction under this law or any violation of an order of protection, then the charges are automatically upgraded to a Class 4 felony.

      I am an attorney, and assuming he has no record and the injuries weren't too severe, I doubt his punishment will be too severe. Also, depending on the victim's feelings, there is a chance the charges are reduced or dismissed.

      However, with the increased public scrutiny on domestic violence because of the NFL, I wouldn't be surprised if BU hands down a severe punishment to him. Including a season long suspension.

          Does anyone else think it is strange that it takes well over a month since this story initially broke, and this is the first we have heard any more about it? And on top of that, the story above was not written by Dave Reynolds. In fact, there is nobody's name attached, it just repeats everything that is in the police reports, and there are no comments from anyone Bradley. Does the PJ Star employ any real reporters any more, or are their stories just created by computer programs that get the info from other sources? Why haven't they tried to get any comments from Barnes or the victim or anyone else who has firsthand knowledge? Its funny the NFL got reamed for a case where nobody was ever arrested or charged,but here we have charges and Bradley sits on it for weeks hoping it will just go away. Did someone drop the ball? Why no interest from the media? It seems bad enough to be a perennial Thursday night team, but now Bradley has criminal issues.

              Auston Barnes has been suspended at least twice previously due to off-the-court issues (once at Central Michigan, and once at Bradley). Will he get a suspension this time? So far no word at all on discipline despite the arrest & charges.

                Barnes' hearing is over and the details are not yet made available but another hearing has already been set for 10/29 at 10am on the court calendar with Judge John Vespa

                  I could perhaps see this as a mistake if he were a freshman, and it were the first occurrence. God knows I was an ***** when I was a freshman. We all were. But domestic violence is not one of those things to be taken lightly. Given his previous off court issues and the fact that he should have it "figured out" by now. I think he should be permanently removed, scholarship and all.

                  And that's going easy on him.

                    The report from the court says that Barnes was officially read his charges today then given until the next hearing (Oct. 29) to prepare his response -
                    I suspect he will negotiate a plea so that he can get supervision....but it wouldn't surprise me if he & his atty ask for a couple delays and continuances
                    and end up with a court date in late Feb. or March so that there will be no suspension

                    one other reports says....

                    "Barnes continues to practice with the team.

                    The Bradley Athletic Department said no disciplinary action has been put into place yet."



                    ....the PJS just posted an article that also quotes head coach Geno Ford as saying, that they are still gathering the facts

                      It's been reported that Auston Barnes entered a plea of not guilty.


                      If Barnes begins the season on suspension then this will be the fourth consecutive season that BU has started with one or more (up to four players) suspended...

                        unrelated - but an example of a D-I team issuing a suspension to a player who had an arrest.
                        VCU's Briante Weber (their best returning player also) plead guilty then was offered court supervision - and has completed all that...
                        now he will serve a 3-game suspension but the coach will include two scrimmages/exhibitions - one of them a closed scrimmage - so that in reality he actually only misses ONE GAME

                        Ironically, Weber, who led the nation in steals - was arrested for STEALING someone's iphone.


                        BTW - at what point do we get the "renegade program" column?
                        Didn't he take the former coach & AD into account for not suspending certain violators?

                                We were told two years ago the minimum suspension is three games when will egolf was arrested. I would guess more like 10, and they will count preseason as part of the ten. I think that is very lenient, and this staff seems to be more lenient than strict. A long suspension or a short suspension wouldn't surprise me either way, as I don't have a firm read on the staff really.
