DR says Kent State was irresponsible, need to be held accountable, as if the lawsuit was improper and negligent...
but correct me if I am wrong - they won by summary judgement with the judge agreeing 100% with every one of their claims...

but their point at the present is that they are trying to be responsible and pursue the most likely avenue to recover what they feel they deserve -
thus they are turning their attention towards the other case and shelving the action against BU...
if there was anything irresponsible - then you'd have to consider actions that led to the lawsuit.
