Default Kent State Lawsuit..

Kent State has filed to drop their claim and lawsuit against Bradley University.

Apparently some sort of settlement or agreement has been reached and thus there will be no trial or further action against Bradley...but they reserve the right to re-file within a year...

Their claims against Geno will continue and is not changed by this action...

This is good news...although we will never know what it all cost....
but as predicted many times and right every one of those times - the fallout from 2011 is still not over..

Is the pjstar article wrong? It says that Kent State recieved absolutely nothing.

The Bradley statement questioned why KSU wasted taxpayer money. It sounds like the opposite of a settlement or agreement.

Sounds to me that unless their is a smoking gun somewhere that after a year Bradley will be in the clear. Geno, on the other hand, is another matter. Sounds like it's really personal against Geno and that Kent State will keep pursuing this for a long time. Does anyone know if BU has been paying for any of Geno's legal fees. Now that BU has been dropped from the suit I'll be interested to see what kind on involvement BU has in support of Geno.

it has been revealed that by agreement Bradley is on the hook for a substantial part of Geno's penalty....(at least $400,000)
and if Bradley receives "nothing" as a result of this action by Kent State then maybe Bradley didn't have to pay...maybe...
...but if there's anything I have learned from my dealings with lawyers - that it's all in the wording and the wording says Kent State gets nothing as a result of the dismissal - it doesn't say they gained nothing whatsoever in any other way...and that would be something we may not know - the results of any settlement - if exists - are virtually NEVER made known....
plus if there were a negotiated settlement - part of the negotiations always are how the facts will be made public so whatever's said is, like everything else, completely negotiable.
After all, they did win their lawsuit against Bradley by summary judgement.
As I said elsewhere - maybe BU just dodged a bullet but getting sued and losing a long, contracted, expensive case can hardly be something to celebrate.


What's obviously good is to avoid the trial and get this whole thing behind us as happened with the other threatened lawsuit in 2011.

from the KSU viewpoint....
"Kent State, not surprisingly, sees the issue somewhat differently.

Emily Vincent, director of media relations for Kent State, issued an email
statement that acknowledged the dismissal of the lawsuit against Bradley.
Kent State said the action “means it will proceed to enforce its contractual
rights against Ford. This next step is based upon the Portage County
Common Pleas decision.”

The rest of the statement read as follows:

“Further, the voluntary dismissal of Bradley University preserves the ability
to seek recovery versus Bradley in the event Ford is unable to satisfy
judgment. In the event that Kent State needs to reassert its claims against
Bradley, there is already an established record through sworn statements,
witness testimony and other evidence.

“Based upon that record and the facts of this case, the court determined
that Bradley University intentionally interfered with the contract between
Kent State University and Geno Ford and that such interference was not
justified.”

More on the Kent State lawsuit after the hearing today...
Kent State is setting aside the effort to go after Bradley and appear to be going full force after Geno Ford for the damages..
but if they don't collect they stand ready to reopen their suit against Bradley University.

I'm really surprised Kent St is still going for GF's throat here. It sure looks petty and probably is scarring off potential coaches in the future. Although I'm not privy to the details, I'm sure GF probably was in breach of his contract someway or another, but what is KSU really gaining here?

College basketball coaches only prosper by building up a successful program and then moving up the ladder to the top echelon of programs. KSU should be appreciative of the work that GF did building a successful enough program to be able to move up to the next tier. Its on KSU to find a replacement that can keep the program playing at a high level and then be ready for that guy to move on up.

All I know is I don't want to be the next guy to try to leave KSU for greener pastures without checking with my lawyers first, that's for sure.

Unfortunately, Geno loses another judge's ruling - judge rules Geno must pay the full $1.2 million plus interest from March 28, 2011 (Not to be reduced by any deductions or withholdings)...final ruling...
"There is no just reason for delay.
Costs to the defendant. It is so ordered."
This effectively ends the case, but expect an appeal.

The PJ Star chimes in and seems to agree with the Ohio judge's ruling - they also say...
"a coach who exits involuntarily expects the former employer to keep its word....
Not so long ago Bradley went through this when Ford's predecessor, Jim Les, was dismissed."

Geno's lawsuit appeal is taking more time in hopes of a settlement - and a request for extension of time has been filed..
in the request there is a comment that a settlement may be near...
"(counsel for the defendant) ..and Kent State University have undertaken discussions aimed at resolving this matter without litigation."

Geno's appeal hearing has been set -
May 21st at 10AM for the judge to hear oral arguments before granting the appeal..

The Ohio District Eleven Court of Appeals' schedule for September is out...

Geno's appeal goes to oral arguments on September 3 at 9:30am

Thankfully none of the judges that preside in the Eleventh District are Kent State alums - but all three are lifetime Ohioans...
